The European Union’s Court of Justice decided that software – on physical media and downloaded from the Internet – can be resold as used software by both individuals and companies. This means that software authors can no longer prevent customers from reselling their products.
The sale of used software is allowed even in case of digitally downloaded programs, as long as the seller deletes every existing copy of the software after delivering it to the buyer. The seller doesn’t have to transfer the program from his computer to the buyer’s, the buyer can simply download a copy from the software vendor’s website. The right to any upgrades or patches is also transferred with the sale of the used software.
